Terms of Service

These Terms of Service ("Terms") govern your use of popupkaraoke.net and the services provided by PopUp Karaoke, LLC ("we," "us," "our"). By booking an event, submitting a request, or using this site, you agree to these Terms.
1. Services
PopUp Karaoke provides mobile karaoke entertainment services, including a professional host/MC, sound equipment, lighting, microphones, song catalog access, and setup/teardown for the booked event time. The specific services included are described in your booking confirmation.
2. Booking & Confirmation
Bookings are confirmed only when (a) you receive a written booking confirmation from us, and (b) we receive your deposit. Submitting a request through our website or by phone does not by itself create a booking. We reserve the right to decline any booking request.
3. Payment
- Deposit: A non-refundable deposit (typically 25–50% of the total fee) is required to confirm the booking date.
- Balance: The remaining balance is due on or before the event date, unless other arrangements are made in writing.
- Methods: We accept payments via Square (credit/debit card), cash, and check. Square processes payments through their secure infrastructure; their terms apply to that processing.
- Travel fees: Events outside our standard service area may incur a travel fee, disclosed at booking.
4. Cancellations & Rescheduling
- By you, more than 30 days before event: Deposit is non-refundable but transferable to a new date within 12 months, subject to availability.
- By you, within 30 days of event: Full balance is due regardless of cancellation.
- By us: If we must cancel for any reason within our control, we will refund all amounts paid and, where reasonable, help you find an alternative provider.
- Force majeure: If the event cannot proceed due to circumstances outside the reasonable control of either party (severe weather, illness, government order, venue closure, power loss, etc.), we will work in good faith to reschedule. Deposits remain transferable in these cases.
5. Client Responsibilities
You agree to:
- Provide an event space with adequate room (approximately 8 × 8 feet) for our setup, sufficient electrical outlets, and access for load-in/load-out.
- Inform us in advance of any venue rules, decibel limits, curfews, or restrictions on sound, lighting, or content.
- Ensure guests behave reasonably. We reserve the right to discontinue performance if our staff or equipment is endangered.
- Notify us promptly of any change in event date, time, or location.
6. Equipment & Damages
All equipment we bring remains our property. The client is responsible for damage to equipment caused by their guests, except for normal wear and tear. We recommend clients verify their event venue or homeowner's insurance covers third-party equipment.
7. Performance Limits
We reserve the right to refuse to perform any song that is illegal, contains content we deem unsuitable for the audience present (especially in venues with minors), or that is unavailable in our catalog. We will work with you in advance on any specific song requirements.
8. Insurance & Liability
We carry general liability insurance and can provide a Certificate of Insurance on request. To the maximum extent permitted by law, our total liability for any claim arising out of or related to our services is limited to the amount actually paid by you for the event in question. We are not liable for indirect, consequential, special, or punitive damages.
9. Intellectual Property
The PopUp Karaoke name, logo, website content, and song-display graphics are owned by us and may not be used without permission. We may take photos/video at your event for promotional purposes; let us know in writing in advance if you do not want this, and we'll respect your wishes.
10. Indemnification
You agree to indemnify and hold PopUp Karaoke, LLC, its members, employees, and contractors harmless from any claim, loss, or damages (including reasonable attorney fees) arising from your or your guests' acts or omissions at the event, except to the extent caused by our negligence or willful misconduct.
11. Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Lake County, Indiana, and you consent to that jurisdiction.
12. Severability
If any provision of these Terms is found unenforceable, the rest remains in full force.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. The version in effect at the time of your booking applies to that booking.
